At the TBMM (Turkish Parliamnet), the draft that predicts the passing from “Kat İrtifakı” to “Kat Mülkiyeti” shall be done by the government “sua sponte” (automatically). In the passing to Kat Mülkiyeti, including the DASK (Obligatory Government Earthquake Insurance) no extra documents will be demanded.
According to the law related with making a change in the Kat Mülkiyeti Kanunu (K.M.K.), the Kat İrtifakı will be changed to the “Kat Mülkiyeti”, without the demand of the property owners who have “Kat İrtifakı”, depending on the property using permission document (İSKAN) in accordance with the law.
To decrease the financial burden and the bureaucracy on the citizens, the list of demanded documents to establish the “Kat Mülkiyeti” will be changed.
The “Notar Approved List” of showing each independent properties land share, genre like floor, apartment or office and signed by all property owners of the building, will not be demanded. The information about the genre of the property like “floor, apartment, office”and their door numbers which start with one and continue succesively, will be shown on the architectural project and the building using permission document.
According to the law which cancels the requirement “to demand the site plan which shows the placements for more than one buildings” to establish the kat irtifakı on a land where the building has not been built yet, to establish the “kat irtifakı” and to register on the tapu registers, the owner of the land or all shareholders should give the project and the administration plan to the tapu office. In passing to the “Kat Mülkiyeti” there will be not an apart demand for the Administration Plan.
Will be done automatically:
After the construction has finished. The changing of the “Kat İrtifakı” to “Kat Mülkiyeti” will be done automatically by the authorized office after the building using permission document (İSKAN) has been sent to the Tapu Office in 60 days after it has been given.
The 1.000 TL Penalty has been Cancelled!
The 1.000 TL administrative fine which would be applied to the one’s who don’t pass to the “Kat Mülkiyeti” before the November 2009 has been cancelled.
In the buildings where the kat irtifakı has been established and all the properties have been finishd and the İskan’s have received before the law came in to force, with the application of one of the property owners application who holds kat irtifakı or by sending the iskan to the related tapu office, the pasing to the Kat Mülkiyeti will be done automatically. In this procedure, including the DASK, there will be no extra documents demanded.
To realign the administration plans of the mass building established before this new law articles, the absolute majority of the property owners association will be enough.
The existing boards of complexes will continue their duties until the administration plan has changed and the new is chosen. The complex administration election will be done in 3 months following the change of the administration plan.
